<span style="font-weight: 400">The Miranda rights include the right to remain silent and the right to have legal representation. The goal of these is to allow a person to avoid incriminating themselves when they’re interacting with police officers. It’s critical to remember that statements you make to police officers can be used in a criminal case against you. </span>

<span style="font-weight: 400">In order to have the protections named in the Miranda rights, you have to clearly invoke them. This means that you make a clear statement, such as “I choose to remain silent,” when you’re interacting with police officers. </span>

<span style="font-weight: 400">Once you invoke your Miranda rights, you should stick to them. This means that you don’t speak to the police in any fashion. Additionally, police officers must stop all questioning. Your invocation applies to the officers who were originally questioning you, as well as all other officers. </span>

<h2>Not understanding how distracting everyday things can be</h2>
Part of the reason drivers continue to drive while distracted is that they might never have stopped to think about how distracting particular tasks or actions are. Many people associate distracted driving solely with handheld phone use, perhaps because this is the issue that lawmakers have directly targeted.

If more people realized that there are three kinds of distraction – visual, cognitive and physical – they might see how many of their actions fit into one, if not more, of those categories. For example, conversing with a passenger takes up some of your thought process (cognitive), and you may well turn to look at them (visual) and use your hands to gesture (physical). That’s all three forms of distraction in one everyday action.

<span style="font-weight: 400">Last year, the </span><a href="https://www.wsbtv.com/news/local/atlanta/georgia-supreme-court-rules-refusing-blood-test-dui-cases-can-be-used-against-you-court/IEWQ4ALGBZBBTMPQHWHMINSOSQ/" data-wpel-link="external" target="_blank" rel="noopener noreferrer"><span style="font-weight: 400">Georgia Supreme Court</span></a><span style="font-weight: 400"> addressed the question of whether it was a violation of a person’s constitutional rights to use a person’s refusal to take a test against them in court. They ruled that it was not.</span>

<span style="font-weight: 400">The case that made it to the high court involved a Fulton County woman who claimed that using her refusal to take a blood test as evidence against her was a violation of her right to protection from unreasonable search and seizure in the Fourth Amendment and her Fifth Amendment right to protection against self-incrimination.</span>

<span style="font-weight: 400">Although the justices ruled unanimously against the defendant, several wrote a concurring opinion noting reasons why a person who wasn’t under the influence might refuse to take a test, including a fear of needles. Of course, a defendant could always present that argument at trial.</span>
<h2><span style="font-weight: 400">A person suspected of DUI can be arrested without a test</span></h2>
<span style="font-weight: 400">It’s important to note that even though someone can’t be arrested for refusing to take a breath or blood test without a warrant, police can still </span><a href="https://www.bajalialaw.com/criminal-defense/dui-defense/" data-wpel-link="internal"><span style="font-weight: 400">arrest them for suspicion of DUI</span></a><span style="font-weight: 400"> based on other factors. These include their driving behavior that caused the stop and whether they act, look or smell like they have been drinking or using drugs.</span>

<span style="font-weight: 400">Certainly, the best course of action is not to drive after consuming any alcohol or drugs. Anyone, however, can potentially find themselves facing police officers who want to give them a breathalyzer test. It’s smart to know the law before having to make a decision in the moment.
