What if an at-fault driver doesn’t have insurance?

Standard procedure after a car crash requires involving outside parties. The people involved in the crash must notify local law enforcement authorities about the incident. They also usually have to communicate with insurance companies to secure compensation for vehicle repairs and injury-related expenses.

The party who is at fault for the crash provides liability insurance coverage for anyone else affected. The law makes basic liability coverage mandatory for all drivers. Unfortunately, some drivers fail to comply with that law. There are people who intentionally cancel their policies to save a little bit of money. There are also some people who forget to make payments or have to make difficult budget decisions that result in a canceled policy.

Thousands of people drive without the insurance required by law. What can the people affected by a crash do when the driver at fault lacks the basic mandatory insurance coverage all drivers should carry?

Legal action may be necessary

Some people have supplemental coverage on their own policies that can help them after a crash. Uninsured motorist coverage and other forms of supplemental coverage can help defray the expenses generated in a wreck. Of course, any claim made could also increase the policyholder’s premiums in the future.

It is usually preferable to hold the person at fault for the crash accountable, and that may require litigation. Personal injury and wrongful death lawsuits can result in compensation awarded to the people affected by the collision.

The courts can award people full compensation for the property damage losses they sustain and any expenses related to injuries. Current and future medical expenses, lost wages and lost earning potential can all contribute to the overall value of a lawsuit. Litigation can provide better reimbursement than insurance coverage, which is subject to strict policy limits.

Occasionally, there may even be reason to bring a lawsuit against a third party. Businesses may have a degree of liability for crashes and scenarios involving drivers on the clock, defective vehicle components and other unusual circumstances.

Pursuing compensation after a motor vehicle collision caused by a driver without insurance can be difficult. Injured people and surviving family members may need help navigating the legal system.
