Catalytic converter thefts were becoming so widespread in recent years that many states, including Georgia, started enacting and amending laws to increase the consequences for those convicted of this offense. Some laws also address those involved in all aspects of the theft and resale of catalytic converters (which are a required part of a vehicle’s exhaust system) and their valuable components.
For example, Georgia Gov. Brian Kemp signed a law in 2023 that increased penalties for stealing catalytic converters. That effort also made it illegal for most people to possess a catalytic converter that’s been removed from a vehicle even if it hasn’t been reported stolen and authorities don’t know what vehicle it belongs to. That means police have the right to arrest anyone they encounter who has a cut catalytic converter, even if they have no report of it being stolen.
What does the law say?
Specifically, the law states that “it shall be illegal for certain persons to purchase, possess, obtain, or sell or attempt to purchase, possess, obtain, or sell used, detached catalytic converters, used utility wire, or used communications copper….”
Catalytic converters can be extremely valuable if they contain rare metals like platinum, palladium or rhodium, which many do, and if they’re still relatively new and in good condition. The parts can be highly valuable on the “black market.”
The human toll of catalytic converter theft
Catalytic converter thefts have also become associated with violence and even deaths. Earlier this year, a Southern California man was shot to death when he confronted men allegedly in the process of removing his catalytic converter. Last year, an actor best known for the soap opera General Hospital was killed when he interrupted a theft. This kind of violence, of course, can occur anywhere when the stakes for getting a catalytic converter – and facing charges for stealing one – are so high.
Since catalytic converter thefts typically involve multiple people, it’s possible for someone to be arrested and charged with this serious offense who had little involvement in an alleged incident.
