Assault crimes are broken up into two categories: misdemeanors and felonies. In Georgia, a simple assault is a misdemeanor, and it occurs when an individual attempts to inflict a violent injury on the victim, or places the victim in immediate apprehension that they will receive a violent injury. In Georgia, aggravated assault is a felony, and it occurs when an individual assaults the victim with the intent to murder, rape, or rob the victim, or when a simple assault is committed with a deadly weapon, or while discharging a firearm while inside a vehicle.
